SOFTWARE AGREEMENT FOR KIS UTILITIES

 

Welcome to KIS Utilities. This agreement is between you and the author of this program. Any mention of software in this document is referring to KIS Utilities.

 

1.1. CONDITIONS OF USE

By clicking the "I agree to the terms of this software agreement" button below, you agree to these software terms.

 

If you disagree with any of the terms below, please click the "I do not agree to the terms of this software agreement" button.

 

By using or distributing this software (or any work based on the software) you shall also be deemed to have accepted the terms and conditions set out below.

 

1.2. SOFTWARE VERSIONS

KIS Utilities exists in 2 versions: Trial Version and Registered Version.

 

The Trial Version expires after 50 tries.

 

The Registered Version does not expire and is entitled to free updates.*

(* i.e. if you purchase KIS Utilities 5.x.x, you are entitled to free updates for all 5.x.x versions of KIS Utilities.)

 

1.3. DISTRIBUTION OF SOFTWARE

Not-for-profit distribution of the Trial Version is permissible, on condition that the software is not altered in any way and is distributed in its entirety.

Electronic transfer, renting, leasing, loaning, selling or distributing of the Trial Version for profit in any form, including but not limited to bulletin board distribution, magnetic or optical medium distribution is not permitted without the written consent of the author.

No portion of the KIS Utilities may not be included as part of any other commercial product.

 

1.4. BACKUP COPIES

You may make any reasonable number of backup copies of KIS Utilities.

 

1.5. DISASSEMBLY

Modification, or alteration of the software including but not limited to decompiling, disassembling, reverse engineering or creation of works arising from the software is prohibited. You may not reverse-assemble or reverse-compile any component of KIS Utilities.

 

1.6. LIMITATION OF RESPONSIBILITY

KIS Utilities is available on the basis that it is accepted as found and that the user checks its fitness for purpose prior to use.

 

This software is provided 'as-is', without any express or implied warranties whatsoever.

 

You will indemnify, hold harmless, and defend the author against any and all claims, proceedings, demands and costs resulting from or in any way connected with your use of this Software.

 

In no event (including, without limitation, in the event of negligence) will the author be liable for any consequential, incidental, indirect, special, aggravated or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of use, business interruption, or loss of information or data), in connection with or arising out of or related to this agreement, this software or the use or inability to use this software or the furnishing, performance or use of any other matters hereunder whether based upon contract, tort or any other theory including negligence and regardless of whether the author has been advised of this possibility of such damage.

 

The author’s entire liability, without exception, is limited to reimbursement to you of the purchase price of this software (maximum being the lesser of the amount paid by you and the suggested retail price as listed by the author) in exchange for the return of the product, all copies, registration passwords and manuals, and all materials that constitute the use and purchase of KIS Utilities back to the author.

 

Such reimbursement will only occur if this software was purchased directly from the author. If you purchased this software through a reseller, distributor, retailer, or third party, your agreement with such parties will govern.

From time to time, the author may make software updates available. However, the author accepts no obligation to provide any support to the holders.

 

1.7. The author allows you to use this software for any purpose subject to the following restrictions:

1. The origin of this software must not be misrepresented; you must not claim that you wrote the original software.

2. You must not alter this software or installer in any way.

3. This notice must not be removed or altered from any distribution.

4. You may not resell or charge for the software.

5. You may not reverse engineer, decompile, disassemble, derive the source code of or modify [or create derivative work from] this software.

6. You must not use this software to engage in or allow others to engage in any illegal activity.
